Purchase – Sale Rules

1. General Provisions
1.1. These electronic store rules (hereinafter – the Rules) are a legally binding document for the Buyer and the Seller: kamivo.com (hereinafter – the Seller), which sets out the rights and obligations of the Parties.
1.2. The Seller reserves the right to change, amend, or supplement these Rules at any time. The Buyer will be informed of changes to the Rules on the e-store website.

2. Conclusion of the Purchase-Sale Agreement
2.1. The purchase-sale agreement between the Buyer and the Seller is considered concluded when the Buyer forms and submits an order for goods in the e-store after becoming acquainted with these Rules.

3. Seller’s Rights
3.1. In case of important circumstances, the Seller may temporarily or completely suspend the operation of the e-store without prior notice to the Buyer.
3.2. If the Buyer attempts to harm the operation, stability, or security of the e-store or violates their obligations, the Seller has the right to restrict or suspend their access to the e-store without warning.

4. Seller’s Obligations
4.1. The Seller undertakes to provide access to the e-store services, under the conditions specified in these Rules.
4.2. The Seller undertakes to deliver the goods purchased by the Buyer via the delivery method chosen by the Buyer, based on the conditions set out in these purchase-sale Rules.
4.3. If, due to unforeseen circumstances, the Seller cannot deliver the goods ordered in the e-store, the Seller has the right to terminate the purchase-sale agreement after informing the Buyer. The Seller may offer a similar product. If the Buyer refuses, the Seller undertakes to refund the paid amount within 3 working days.
4.4. If the Buyer exercises the right specified in clause 5.2 of the Rules, the Seller undertakes to refund the amount paid by the Buyer within 5 (five) working days from the date of receiving the returned product.
4.5. The Seller may withhold the refund until the goods are returned or until the Buyer provides proof that the goods have been sent back, whichever occurs first.

5. Buyer’s Rights
5.1. The Buyer has the right to purchase goods in the e-store according to these Rules.
5.2. The Buyer has the right to withdraw from the purchase-sale agreement concluded in the e-store by notifying the Seller in writing no later than within 14 (fourteen) calendar days from the day of delivery.
5.3. The right referred to in clause 5.2 can be exercised only if the product has not been damaged or substantially changed in appearance and has not been used.

6. Buyer’s Obligations
6.1. The Buyer must pay for the purchased goods and accept them under the procedures set out in these Rules.
6.2. If the Buyer refuses to accept the goods at the time of delivery without a valid reason, the Buyer must cover the return costs upon the Seller’s request.
6.3. At the time of delivery, the Buyer must check the condition of the package and goods with the Seller or the delivery person.
6.4. By using the e-store, the Buyer confirms agreement with these purchase-sale rules and agrees to comply with them.

7. Prices of Goods
7.1. Product prices in the e-store are shown in euros and include VAT. Upon order confirmation, a delivery fee is added to the total amount, if applicable.

8. Ordering and Payment for Goods
8.1. The Buyer visits the e-store, selects the desired products, and adds them to the shopping cart. After forming the cart, the Buyer enters personal data required to fulfill the order: name, surname, delivery address, phone number, and any additional information important for delivery. The Buyer confirms having read these Rules and confirms the order.
8.2. Payment can be made using electronic banking services of Swedbank, SEB, Luminor, Citadele, Šiaulių Bankas, or with Visa / MasterCard cards. Payments are accepted in EURO currency. Payments are processed through the MakeCommerce.lt platform.

9. Delivery of Goods
9.1. When ordering, the Buyer must specify an accurate delivery address.
9.2. The Buyer must accept the goods personally. If the Buyer cannot accept the goods but they are delivered to the address provided, the Buyer has no right to raise complaints about delivery to the wrong person.
9.3. The Seller delivers the goods within the timeframe specified in the product descriptions.
9.4. All product characteristics are provided in the descriptions. The Seller is not responsible for any discrepancies in color, shape, or other parameters due to monitor settings.
9.5. If the Buyer withdraws from the purchase-sale agreement, all paid amounts, including delivery costs, will be refunded.

10. Return of Goods
10.1. Quality goods can be returned within 14 days of receipt. Defects of defective goods are corrected or the goods are replaced or refunded according to the Civil Code of the Republic of Lithuania.
10.2. The following conditions must be met when returning goods:
10.2.1. The returned item must be in original, intact packaging (this does not apply to defective goods);
10.2.2. The item must be undamaged by the Buyer;
10.2.3. The item must be unused and retain its marketable appearance: labels not damaged, protective films intact, etc. (not applicable to defective goods);
10.2.4. The item must be returned in the same set as received (not applicable to defective goods);
10.2.5. The Seller has the right to refuse the return if the return conditions are not met;
10.2.6. Returns must be made using the method specified by the Seller within 14 (fourteen) days of receipt (not applicable to defective goods, which are returned within the statutory warranty period);
10.3. Returns and exchanges of quality goods are made according to Article 6.228(10), Part 1 of the Civil Code;
10.4. Money for accepted but later returned goods is refunded to the Buyer’s account no later than within 5 (five) days after the Seller receives the returned goods, unless otherwise agreed.

11. Final Provisions
11.1. These Rules are made in accordance with the laws of the Republic of Lithuania.
11.2. These Rules and the relations between the Parties under these Rules are governed and interpreted based on the laws of the Republic of Lithuania.
11.3. All disputes regarding the execution of these Rules are resolved through negotiations. If an agreement is not reached, disputes are resolved as provided by the laws of the Republic of Lithuania.
11.4. The Parties are released from their obligations under these Rules if their execution is impossible due to unforeseen and uncontrollable circumstances (Force Majeure).
